Terms and Conditions for Snap East Bay Photography
Scope of Work: This agreement outlines the terms for family portrait photography services provided by Snap East Bay Photography. The specifics of each photography session, including date, location, duration, and special requests, will be agreed upon in advance between the client and the photographer. By booking a session, you agree to have your photograph taken by our photographers.
Copyright and Usage Rights: Snap East Bay Photography retains copyright of all images taken. Clients are granted a non-exclusive, non-transferable license to use the photographs for personal, non-commercial purposes only. The photographer reserves the right to use the photographs for promotional, advertising, and other professional purposes.
Package Details and Pricing: The details of the portrait package, including the total cost, number of images provided, and any additional services, will be clearly stated in the contract. Payment terms, including deposit requirements and balance payment schedule, will be specified.
Cancellation & Lateness Policy Clients can easily cancel or reschedule at any time up to 10:00am two days before a scheduled session. If Client cancels after this time, Client agrees to pay a $40 fee to cover your Photographer’s time and forfeiture of other paid gigs. If Client is more than 10 minutes late to a session start time, Client agrees to pay a late fee of $20-$40 depending on time of arrival. If Client does not cancel and fails to show up at their session, Client will be automatically charged a $75 no-show fee.
Liability: Snap East Bay Photography will not be held liable for any unforeseen circumstances that prevent the completion of the photography service, such as weather conditions, illness, or equipment failure. In such cases, efforts will be made to reschedule the session or provide a refund.
Client Cooperation: Clients are expected to arrive on time and cooperate during the session. The photographer will not be held responsible for photographs not taken due to client’s delay or non-cooperation.
Final Image Delivery: The final edited images will be delivered to the client within 2-3 weeks after the session. The method of delivery (online gallery, USB drive, etc.) will be agreed upon in advance, but typically delivered digitally via website.
Permit and Location Fees: If the photo session requires a permit or incurs location fees, such as in public parks or private venues, the client is responsible for obtaining and paying for the necessary permits and fees.
Amendments to the Contract: Any amendments to this contract must be in writing and signed by both parties.
Governing Law: This contract shall be governed by the laws of the state in which Snap East Bay Photography operates.
Model Release
Permission: I grant Snap East Bay Photography and their legal representatives the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for editorial, trade, advertising, educational, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same.
Use and Disclosure: I agree that the Snap East Bay Photography may use such photographs of me with or without my name and for any lawful purpose, including, but not limited to, publicity, illustration, advertising, and web content.
Release and Waiver: I release and discharge the Snap East Bay Photography from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy.
Ownership: I acknowledge and agree that I have no ownership rights in the photographs and that all copyright and ownership belongs to Snap East Bay Photography.
Compensation: I understand that I will receive no compensation for the use of the photographs.
Personal Information: I understand that my personal information may be used in connection with the use of the photographs.
Minor Model Release (if applicable): If the model is a minor, you agree as a parent or legal guardian to the consent of your child in social media, training, and marketing material.
